Brake light flickering without e-brake?

Well I've never seen the brake light come on unless I pull the e-brake, but since my pads are wearing down and I have ABS would the light come on as a warning? It was flickering during my drive home tonight.

if your pads are wearing down, then chances are there isn't much fluid in the master cylinder so that could be triggering the light to come on.
