P0403 is still around

Ok so...did my ecu swap (6g72) and have the big maps patch and all that on it...I keep tripping P0403 but I cannot figure out why. I thought I went through and disabled it. After I tried to disable it I went through with a ob2 scanner and cleared it. Start the car right away and no light but once I turn the key off and start it again it comes back! On the scanner it says "X number of codes" and it has P0403 and P0403 p/d (pending) but when I clear it they both go away...WTF am I doing wrong?

Here is the stuff I have checked looking at trying to turn it off. Do I need to switch the monitor passed stuff too? Someone told me not to mess with it cuz it didn't matter
