He has every right to talk to the cops while on his phone, there is no law against it. It's not like your not cooperating with police because you can cooperate while you talk.

typically, we'll ask you to please get off the phone, if you refuse, i'll demand you to get off the phone, if you don't, then i'll tell you to get out of the car with my hand on my gun, unclipped slightly pulled, any delay in response while being investigated on a stop or call gives reason for suspicious possible harm to be caused to an officer. if he then refused, i would of pulled his ass out of the car.
